1. Introduction

Welcome to eScripts.co.uk ("Website"), operated by eScripts Ltd ("Company", "we", "us", or "our"). By using our Software-as-a-Service ("SaaS") platform, you ("User", "you") agree to abide by these Terms and Conditions. eScripts allows registered medical and veterinary clinics to issue electronic private prescriptions ("eScripts").

2. Definitions

• Platform: The eScripts SaaS system available via escripts.co.uk.
• Clinic: A medical or veterinary clinic registered on eScripts.
• Primary Prescriber: The first prescriber registered for a Clinic who is responsible for verifying additional prescribers.
• Token: A unit of payment used to issue electronic prescriptions.
• Prescription: An electronic prescription issued via the Platform.
• Payment Processor: Stripe, our third-party payment processor.
• Prescriber: A registered medical or veterinary professional authorised to issue prescriptions.

3. Registration and User Responsibilities

3.1. Account Creation

The Primary Prescriber must upload valid identification during registration, which will be reviewed by us. Additional prescribers are added at the discretion of the Primary Prescriber, who assumes responsibility for their legitimacy.

3.2. User Responsibilities

• Users must ensure that all data entered into the platform is accurate.
• Prescribers issuing prescriptions are responsible for ensuring prescriptions comply with relevant regulations and are clinically appropriate for the patient the prescription is issued to.
• Pharmacists dispensing prescriptions are responsible for checking the legality and clinical appropriateness of prescriptions generated by the Platform.
• The Company does not provide clinical checks or verify the appropriateness of prescriptions.
• Prescribers must ensure they are registered with the appropriate regulatory body (e.g., GMC, GPhC) and comply with all relevant laws and regulations.
• Prescribers must prescribe within their scope of practice and ensure the patient is under their care.
• Prescribers must remain registered with the appropriate regulatory body and inform us of any changes to their registration status.

4. Pricing and Payments

• Users receive 5 free tokens upon registration.
• Additional tokens are charged at £1 + VAT per token, with a minimum purchase of 5 tokens.
• Repeatable prescriptions incur charges for each dispensing instance (e.g., an initial dispensing and five repeats will require 6 tokens).
• Users can enable automatic top-up, ensuring their balance remains at 5 tokens.
• Refunds will not be issued for used tokens. Unused tokens may be refunded at our discretion.
• Payments are made via Stripe (Payment Processor) who accepts all major credit/debit cards.
• We do not store any credit/debit card information.

5. Service Availability

• We aim to maintain at least 99% uptime but do not guarantee uninterrupted service.
• As eScripts does not operate on a subscription model, no compensation will be provided for service interruptions.

6. Data Storage and Security

• All data is stored securely in the UK using industry-standard encryption methods.
• Users are responsible for ensuring their login credentials remain confidential.
• The Company acts as a Data Processor and has no control over the accuracy or content of stored data.

7. Account Termination

• Users may request to terminate their account at any time by contacting us.
• We reserve the right to suspend or terminate accounts that breach these Terms and Conditions.

8. Limitation of Liability

• eScripts Ltd shall not be liable for:
• Any clinical decisions made by prescribers using the platform.
• Losses resulting from service downtime or technical issues beyond our control.
• Any misuse of the platform by Users.

9. Amendments to Terms

We reserve the right to update these Terms and Conditions. Users will be notified of any significant changes.

10. Governing Law

These Terms and Conditions are governed by the laws of England and Wales. Any disputes shall be resolved in the courts of England and Wales.
